This agreement contains the entire understanding between Courtney Danielle Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.

Upon your signature and received retainer fee of $500, Courtney Danielle Photography will reserve the date agreed upon and will not make other reservations for that date. For this reason, the retainer fee is non-refundable if the wedding is cancelled for any reason; including acts of God, fire, or extreme weather. The retainer fee is to be paid at the time of signing the agreement, and will be applied towards the contracted wedding photography package. The client understands and agrees that the entire amount owed for the wedding photography package described in the agreement is due on or before the clients wedding date.

In the event that the client cancels the contracted services for wedding photography outlined in this agreement before the wedding ceremony takes place, the retainer fee will be forfeited. Courtney Danielle Photography agrees to refund all additional paid money to the client.

The parties agree to a pre-event consultation, whether it be in person or over the phone, before the wedding date in order to finalize the actual shooting times and locations. This can occur at the time of the engagement session or via phone/email if necessary.

The client will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will NOT be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).

If formal portraits are to occur before the ceremony, photography should begin at least two hours prior to the ceremony. If the client wishes to have formal portraits taken after the ceremony, a 60 minute time frame is required at that time. The 60 minutes following the ceremony includes group photographs, unless taken before the wedding. If the couple desires both indoor and outdoor coverage, more time may be required. If the bridal party's lateness or any other reason outside of the photographers control prevents ample time for photography, Courtney Danielle Photography shall not be held liable for failure to take desired photographs.

The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Courtney Danielle Photography is not responsible for key individuals' failure to be present or to cooperate during photography sessions, neither for missed images due to details not revealed to Courtney Danielle Photography. It is recommended that the client designate an "event guide" to point out important individuals to the photographer, whom the client wishes to include in informal or candid photographs.

The photographer is limited by the guidelines of the ceremony official or the reception site management (for example, a church that does not allow photographs during the ceremony). The client agrees to accept technical results of their imposition on the photographer. Negotiation with officials for moderation of guidelines is the client's responsibility.

The digital images or prints produced by Courtney Danielle Photography are protected by copyright law and may not be reproduced in any manner without Courtney Danielle Photography's explicit written permission. Upon final payment by the client, a release will accompany the digital images which allows the client to print images at any photo lab of their choosing, at any time of their choosing. Courtney Danielle Photography will give printing recommendations as well. The client must obtain written permission from, and compensate Courtney Danielle Photography prior to an event where the client, the client's friends or relatives publish or sell the photographs for profit. If images are used in social media, they need to bear the byline "Photo by Courtney Danielle Photography". In addition, photos cannot be digitally altered and posted on social media.

The client hereby grants Courtney Danielle Photography the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. It is agreed that Courtney Danielle Photography may display and use the photographs taken for advertising, display, website and internet promotion, and any other purpose thought proper by Courtney Danielle Photography.

It is understood that Courtney Danielle Photography will act as the sole and exclusive wedding photographer. Because of time constraints, the need for subjects to pay full attention to the professional photographer, and the fact that flashes from guests; cameras may ruin shots taken by Courtney Danielle Photography, guest photography needs to be limited. The formal photography time is for the use of Courtney Danielle Photography to capture the formal wedding portraits.

Courtney Danielle Photography will provide the client with an online digital gallery of fully edited, high resolution images within 6-8 weeks after the wedding date. If the client wishes to order prints through Courtney Danielle Photography, they will be ordered promptly and delivered when the printing is completed. The balance for the prints will be due at the time of ordering.

Payment may be made with cash, check or money order. Returned checks will be assed a $50 non-sufficient funds fee, and any future purchases/payments will need to be made via cash, money order or paypal. If payment is made via paypal, a % will be added to the total price. If payment is mailed, but not received by Courtney Danielle Photography, proof of payment will be requested or a new payment must be sent. It is advisable, if sending payment, to do so via certified mail.

In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Courtney Danielle Photography will make every effort to secure a replacement photographer able to provide a similar package as chosen in this contract at the same/similar price. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. Courtney Danielle Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of the client's photographs being lost, stolen or destroyed for reasons within or beyond Courtney Danielle Photography's control, the latter's liability is limited to the return of all payments received for the even package. The limit of liability shall not exceed the contracts price stated herein. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Although every possible care will be taken to produce photographs of all important and special events during the wedding, Courtney Danielle Photography cannot place an unconditional guarantee on the above. Courtney Danielle Photography will not be held responsible for comprised coverage due to guests' flashes, lateness of bridal parties, existing background, lighting conditions, weather conditions or house rules that would negatively impact or restrict photography.

Client agrees to pay photographer the deposit amount at the time of booking to secure their wedding date. This is a non-refundable retainer fee that goes toward your total price. The final balance is due on or before the scheduled wedding date. The fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer. Additional editing is available at additional expense to be determined by photographer. Prints or digital images may be available for purchase.

If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of this agreement shall remain in full force and effect.

The client is responsible for mileage that is outside 30 miles of the Baudette, MN area. Any distance that is greater than 30 miles will be charged an additional .50¢ per mile, unless otherwise stated. The client is responsible for a meal for Courtney Danielle Photography and 1-2 assistants if covering the reception, unless there is time specified to leave for a meal break. If Courtney Danielle Photography will need any hotel accommodations of any kind in order to cover your wedding day, it is the clients responsibility to cover this expense. If any other additional traveling expenses are required, it is the clients responsibility to cover these costs.

This contract has been freely negotiated and shall be recognized as the entirety of the agreement. Only those changes or modifications made specifically placed in writing, attached, dated and signed by the client and Courtney Danielle Photography at the time of acceptance of this contract shall be recognized as amendments to this contract.
